What is it about?
When the German FCJ issued the decisions FRAND Objection I and FRAND Objection II in 2020 in the dispute between Sisvel and Haier, it seemed like the ongoing discussion about the interpretation of the CJEU decision Huawei v ZTE (C-170/13) was decided in Germany in favor of a holistic approach with a large emphasis on the implementer’s willingness to take a license. In 2024, however, the European Commission surprisingly filed an amicus curiae brief in pending infringement appeal proceedings between VoiceAge and HMD at the Higher Regional Court of Munich, supporting a strictly sequential interpretation of the CJEU decision. After the Higher Regional Court of Munich rejected this approach, the case went to the FCJ which now issued its eagerly awaited decision.
