What is it about?
The trade of illicit goods, from counterfeits to gray goods, continues to cause significant economic losses for IPR holders and jeopardize consumer safety and health (<link www.keepeek.com/Digital-Asset-Management/oecd/governance/trade-in-counterfeit-and-pirated-goods_9789264252653-en _blank>OECD/EUIPO 2016 «Trade in Counterfeit and Pirated Goods – Mapping the Economic Impact»</link>).
Public authorities have consistently expressed their intention to stop counterfeiting by tightening controls and increasing penalties, such that there is today a comprehensive legal arsenal to combat IPR violations.
Despite this, the phenomenon of counterfeiting, amplified by e-commerce, appears far from being brought under control. The issue is perhaps not so much the deficiency of the legal framework as the timely detection of counterfeits and the identification of their origin.
Could new technologies in the area of traceability, and specifically blockchain technology, provide an effective response to the "scourge" of counterfeiting?
