The distribution of cases across the UPC’s Local, Regional, and Central Divisions has become a hotly debated topic in patent litigation. Following certain proposals for regulatory intervention, BARDEHLE PAGENBERG’s open letter, survey results, and a lively discussion across the IP community, the key questions remain: Does the current distribution reflect a problem that needs fixing, or just the natural dynamics of a system that is working?
