The State of Play at the UPC – Insights and hands-on experience from active UPC Litigators

The UPC landscape is being shaped at a breathtaking pace, requiring users to constantly adapt their strategies. With more than 340 pending cases at the end of April 2024, the Unified Patent Court (UPC) is not only a reality, it is on its way to becoming a center of gravity for resolving global patent disputes. The first substantive decisions have been issued and important trends are emerging. In particular:

  • It has become quite clear that preliminary injunctions are readily available at the UPC whereby the legal framework for obtaining interim relief is generally favorable to patentees. 
  • The first judgments in main proceedings are about to be handed down and the first permanent injunctions are expected.
  • The details of the procedure at the UPC are being shaped by several new decisions every week as best practices and pitfalls emerge.
  • The UPC entertains forum shopping and insofar, the Munich Local Division (but also the other German Local Divisions) are apparently the place to go.
