Ten months after the start of the European Unitary Patent and the UPC: Active practitioners report on how Chinese companies can adjust and complement their prosecution and litigation strategies

Joint IP Event by Han Kun Law Offices and BARDEHLE PAGENBERG

The European Unitary Patent (UP) and the Unified Patent Court (UPC), with about 300 cases filed so far, have become a reality since June 1, 2023. The first substantive decisions have been issued and important trends are emerging.

We invite you to our IP Event with attorneys from BARDEHLE PAGENBERG, involved in more than 60 of these UPC cases, in cooperation with attorneys from Han Kun Law Offices.

Please join us on Wednesday, March 27, 2024, at 2:45 pm Beijing Time, at the Han Kun Law Office in Shenzhen.

Format: Hybrid (in-person attendance plus live stream to allow international participation)

Conference language: English, with simultaneous translation into Chinese

We will provide you with insights on what these developments mean from a Chinese perspective, what to consider from a prosecution perspective, how Chinese companies can adjust and complement their enforcement and defense strategies in light of the emerging legal framework, and how Han Kun Law Offices can assist Chinese companies in their UPC prosecution/litigation.

In particular:

  • Pros and cons of the UP compared to EP and national patents
  • New risk of preliminary injunctions for implementers and for protective letters
  • How the UPC speeds up patent litigation and enlarges the geographical region where patents can be enforced in a cost-efficient manner
  • Forum shopping and why German UPC Divisions are leading by far
