The UPC turns three: statistics, milestones, and trends

Live webinar

Three years after its launch on June 1, 2023, the Unified Patent Court has already established itself as a central forum in global patent litigation.

In this webinar, Prof. Dr. Tilman Müller-Stoy and Dr. Johannes Möller will walk you through some key statistics and early trends of the UPC’s first three years.

The webinar covers the following aspects:

  • How fast is the UPC? Average durations across preliminary injunction proceedings, infringement main actions, and standalone revocation proceedings and what these timelines mean for litigation strategy.
  • What are the win rates in preliminary injunction proceedings? A descriptive look at win rates so far, the most common reasons for refusal, and procedural patterns such as ex parte grants and enforcement security.
  • What are the win rates in main infringement and revocation proceedings? Across infringement main actions, counterclaims for revocation, and standalone revocation actions, including what has driven revocation outcomes to date.
  • EPO vs. UPC: where have outcomes diverged and why? Including an early assessment of whether the UPC’s holistic approach to inventive step has so far produced different results from the EPO’s problem-solution approach – and what the available decisions suggest about the actual drivers of divergent outcomes.

The session will include an interactive Q&A, giving participants the opportunity to raise questions and contribute their perspectives.
