In June 2023, the international Unified Patent Court (UPC) was launched in 18 EU member states. Since the start of the UPC, BARDEHLE PAGENBERG has been involved in numerous UPC cases and has consolidated its position as a leading firm, trusted to represent both plaintiffs and defendants. With 18 months having passed and more than 500 pending cases, the UPC has already become a global hub for patent litigation. With decisions being issued every week, the court is rapidly shaping both procedural and material law.
Join three active UPC litigators involved in over 60 UPC actions to discuss what these developments mean from a Japanese perspective and how Japanese companies can adjust and complement their enforcement and defense strategies in light of the emerging legal framework. Our litigators will provide an overview of the new system and the latest case law, and will share their first-hand experiences in English and Japanese, discussing in particular:
- UPC case law: indirect infringement, doctrine of equivalence, liability of companies and executives
- The UPC’s approach to validity: adoption of EPO standards or development of an independent approach?
- Emerging case law on SEPs and FRAND
- Preliminary injunctions
Please join us in person on Thursday, January 30, 2025, at 5 p.m. - 6.30 p.m. JST at the Hotel Okura in Tokyo.
After our presentation and the discussions (after 6:30 p.m.), we would be delighted to continue our exchange and to meet you personally over finger food and beverages. We look forward to furthering our understanding and engaging in conversation with you.
You will leave with the following takeaways:
- Insights into how the UPC is operating, what the UPC time schedules and case management looks like, and how internal workflows should be optimized
- Clarity on the most relevant case law handed down by the UPC
- Ways to improve offensive and defensive strategies involving this new forum
- A better understanding of what the UPC really means from a Japanese perspective
We very much look forward to meeting you in person in Tokyo!
Please note that the registration deadline is January 24. Seats are limited by the venue.
