BARDEHLE PAGENBERG offers its clients a full range of trademark-related services ranging from national and international brand portfolio development, trademark clearance and prosecution through to enforcement, including trademark litigation both on a national and multinational level. Particular emphasis is placed on providing strategic advice, especially with regard to multinational portfolios, which particularly involves combining Community trademarks and international registrations under the Madrid Agreement.

Our practice also actively pursues the new measure of enforcing prior unregistered trademarks or trade designations in opposition proceedings in Germany. Until the relevant amendments to the German Trademarks Act, such rights could only be enforced by bringing an action before the civil courts.

The fight against product piracy is gaining momentum. For many years now, we have been working closely with customs authorities to monitor imports and exports, and to prevent and seize grey-market imports. We also advise and support trademark owners in commercial transactions such as acquisitions, licensing, merchandising, franchising, joint ventures and co-existence agreements.

Our trademark lawyers have extensive experience handling trademark cases before the trademark offices as well as before all German regional and higher regional courts competent to hear such cases. BARDEHLE PAGENBERG’s lawyers also represent clients in appeal cases before the German Federal Court of Justice, as well as the General Court and the Court of Justice of the European Union.
