When drafting claims for inventions in the field of electrical engineering, we take special care to ensure that all separate aspects of an invention are protected independently. Focusing independent claims merely on the overall system creates problems when it comes to enforcing the patent against a competitor producing or distributing just the components of the overall system. The case law of the German Federal Court of Justice has frequently shown that deficiencies in the definition of the elements to be protected cannot subsequently be corrected when enforcing the patent.

We also place particular emphasis on drafting claims abstracted from the specific hardware and software implementation of a circuit. While the components of a circuit may change over the 20 year term of patent protection, the functional elements are frequently maintained. Hence, with functional wording, it is possible to exhaust the possibilities of patent law and avoid problems with evidence or costly re-engineering in infringement proceedings.
