With about 300 cases filed so far, the Unified Patent Court (UPC) is definitely a reality. The first substantive decisions have been issued and important trends are emerging. In particular:
- It has become quite clear that preliminary injunctions are readily available at the UPC whereby the legal framework for obtaining interim relief is favorable to patentees. If the patentee is “good for the money”, such preliminary injunctions may even be enforceable without the need to post a bond. From the implementer’s view, protective letters are a double-edged sword since they may do more harm than good.
- The UPC entertains forum shopping and insofar, the Munich Local Division (but also the other German Local Divisions) are apparently the place to go.
