Ten months after the European Unitary Patent and the UPC has started: Active practitioners report on how Chinese companies can adjust and complement their prosecution and litigation strategies

Joint IP Event by Watson & Band and BARDEHLE PAGENBERG

The UPC landscape is being shaped at breathtaking speed, requiring users to constantly adapt their prosecution and litigation strategies. Join four attorneys from the law firm BARDEHLE PAGENBERG which is involved in more than 60 UPC actions, in cooperation with lawyers from Watson & Band.

Please join us on Wednesday, March 26, 2024, at 3 pm Beijing Time, in Shanghai, at the headquarter of Watson & Band.

Format: Hybrid (in-person attendance plus live stream to allow international participation)

Conference Language: English (simultaneous translation into Chinese will be provided onsite)

With about 300 cases filed so far, the Unified Patent Court (UPC) is definitely a reality. The first substantive decisions have been issued and important trends are emerging. In particular:

  • It has become quite clear that preliminary injunctions are readily available at the UPC whereby the legal framework for obtaining interim relief is favorable to patentees. If the patentee is “good for the money”, such preliminary injunctions may even be enforceable without the need to post a bond. From the implementer’s view, protective letters are a double-edged sword since they may do more harm than good.
  • The UPC entertains forum shopping and insofar, the Munich Local Division (but also the other German Local Divisions) are apparently the place to go.

We invite you to discuss what these developments mean from a Chinese perspective, what to consider from a prosecution perspective and how Chinese companies can adjust and complement their enforcement and defense strategies in light of the emerging legal framework.

After our presentation and the discussions (until 6 pm), we would be delighted to continue our exchange and to meet you personally over finger food and beverages.
