Dr. Hans Wegner’s areas of practice as a patent attorney relate to patents, utility models and designs, particularly in the fields of telecommunications and consumer electronics (e.g. mobile phone technology, multimedia) and hardware/software (e.g. server architectures, databases), as well as mechanics (e.g. sports equipment, medical technology), new materials (e.g. high-temperature superconductors) and measuring technology (e.g. for photolithography and the machine tool industry).
Besides regularly representing clients in patent application proceedings before the German Patent and Trademark Office and the European Patent Office, Dr. Hans Wegner also defends and attacks patents in opposition proceedings and has very successfully represented clients in many adversary proceedings, particularly before the Opposition Divisions and Boards of Appeal of the EPO.
Another main area of Dr. Hans Wegner’s practice as a patent attorney involves enforcing IP rights before the German courts hearing infringement actions and in parallel nullity proceedings before the German Federal Patent Court and the German Federal Court of Justice. Armed with this experience, Dr. Hans Wegner is able to provide highly qualified expert advice to clients seeking to establish a portfolio of valuable patent assets and successfully enforce them against competitors where litigation arises.
In recent years, his consultancy work with clients in the course of FRAND license negotiations relating to standard-essential patents (SEPs) has increasingly gained in importance, for example for one of the world’s leading manufacturers of consumer electronics. The use and validity of licensed IP rights form the subject of in-depth analyses by Dr. Hans Wegner and his team of experts, with these analyses being an essential prerequisite for both the licensor and the licensee in order to establish a FRAND license agreement. Dr. Hans Wegner’s extensive experience in proceedings before the courts hearing infringement actions also allows him to realistically assess the litigation risk should license negotiations break down.
In addition, Dr. Hans Wegner has frequently served as an expert in patent law for members of the German Parliament.
Dr. Hans Wegner is the author of the chapter on Germany in "Software Patents Worldwide" and other publications relating to his practice.
