Henning Hartwig, partner in the Munich office, and Giovanni Casucci, partner in the Milan office, have been frequently recommended as true experts in European and national design law. Both have a main focus on multinational design infringement proceedings as well as invalidity proceedings before the Office for Harmonization in the Internal Market in Alicante and the Court of Justice of the European Union in Luxembourg – and both publish regularly on design, copyright and trademark law. Now, BARDEHLE PAGENBERG is happy to share two country chapters on German and Italian industrial design law, providing a simple, easy-to-use digest of some of the main issues involved in the protection, enforcement and exploitation of designs. Both chapters outline the legal framework and registration procedures in the respective jurisdiction, considering the treatment of unregistered rights, the protection available for trade dress and the safeguarding of rights through other legal avenues, as well as presenting strategic enforcement advice.
