{"id":400,"date":"2019-02-28T14:48:13","date_gmt":"2019-02-28T13:48:13","guid":{"rendered":"https:\/\/www.bardehle.com\/europeansoftwarepatents\/?p=400"},"modified":"2019-04-30T17:01:03","modified_gmt":"2019-04-30T15:01:03","slug":"european-software-patents-february-2019-updates","status":"publish","type":"post","link":"https:\/\/www.bardehle.com\/europeansoftwarepatents\/european-software-patents-february-2019-updates\/","title":{"rendered":"EUROPEAN SOFTWARE PATENTS February 2019 updates"},"content":{"rendered":"\n<p><strong>February 2019 marks the proud start of <a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\">EUROPEAN SOFTWARE PATENTS<\/a> with the first batch of decisions:<\/strong><\/p>\n\n\n\n<p>Two somewhat older decisions relate to the very <strong>fundamentals of the EPO&#8217;s software patent examination standard<\/strong>: According to the &#8220;any hardware approach&#8221;, <a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\/knowledge-base\/methods-which-use-technical-means-are-patent-eligible\/\">the patent eligibility hurdle only requires one single technical feature<\/a> (e.g. a computer). The challenging test for most European software patents is inventive step, where <a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\/knowledge-base\/only-technical-features-can-establish-an-inventive-step\/\">only those features which contribute to the solution of a technical problem are taken into account<\/a> (the so-called &#8220;<a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\/knowledgebase\/only-technical-features-can-establish-an-inventive-step\/\">Comvik<\/a> approach&#8221;).<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Concerning <a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\/knowledge-base-category\/programming\/\"><strong>programming<\/strong><\/a><strong> and <\/strong><a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\/knowledge-base-category\/modelling-simulation\/\"><strong>modelling\/simulation<\/strong><\/a>, we added decisions where the European Patent Office refused to grant a software patent for <a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\/knowledge-base\/method-of-using-parallel-processing-constructs-not-patentable\/\">parallel programming constructs<\/a> as well as for <a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\/knowledge-base\/programming-modelling-new-programming-languages-non-technical\/\">programming, modelling and new programming languages<\/a>. Another more recent case related to a software patent for an <a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\/knowledge-base\/expert-system-for-assessing-a-patent-not-patentable\/\">expert system for assessing patents<\/a>.<\/p>\n\n\n\n<p>Two decisions concern <a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\/knowledge-base-category\/mobile-phones-apps\/\"><strong>mobile phones \/ apps<\/strong><\/a>. The European Patent Office refused to grant a software patent on the concept of <a href=\"https:\/\/www.bardehle.com\/europeansoftwarepatents\/knowledge-base\/automatically-uninstalling-apps-after-trial-phase-non-technical\/\">automatically uninstalling apps after the trial phase<\/a>.
