What is it about?
The European Unitary Patent has been available since June 1, 2023. This new option allows applicants to validate their European patents in a larger number of jurisdictions at a relatively low cost. Ten months after its launch, we look at who is using it and who believes that the old bundle patent is still the better choice for them.
Another decision that applicants and patentees face since June 1, 2023, is whether to opt their European patents out of the jurisdiction of the new Unified Patent Court (UPC). With the first available decisions suggesting that the UPC will be a plaintiff-friendly forum, is it time to reconsider the strategy of opt-outs for the entire portfolio that many companies have adopted?
